The IRS only recognizes two statuses… “citizen or resident (alien) of the United States” OR non-resident alien. Tax status and immigration status have NOTHING to do with each other.
Just not filing will often lead folks down the road of the IRS creating an SFR/Substitute For Return for them. Far better to just handle it administratively and get them to AGREE your gross income is zero. After all, NRAs have a different section of the IRC that governs what is and is not “gross wages” than US Persons (citizens and resident aliens) do!
